General Terms and Conditions

Scope of application

The following General Terms and Conditions (GTC) govern the sale of admission tickets (“tickets”) to customers/purchasers for events organized by Mayence Music Management GbR (“MaMuMa”) in its own name. This includes the event itself and all related ancillary services.

1. Conclusion of contract

The ticket providers selected by MaMuMa have systems set up in such a way that all tickets for an event that are still available for sale via the Internet are marked in color as available. The customer can select seats from the available contingent and collect them in a so-called shopping cart by clicking on the seats. By clicking on the “order with obligation to pay” button (or similar), the customer submits a binding request to purchase the tickets in the shopping cart. Before submitting the order, the customer can review the data again and change it if necessary. The request is submitted and transmitted when the customer clicks on the “order with obligation to pay” button (or similar). By doing so, they automatically accept the General Terms and Conditions. The respective ticket system then sends the customer an automatic confirmation of receipt, in which the customer’s order is listed again. The automatic confirmation of receipt merely documents that the customer’s order has been received and does not constitute acceptance of the order. The contract is only concluded when a declaration of acceptance is sent in a separate email (order confirmation).

2. Delivery, availability of goods

If no tickets are available in the price category selected by the customer at the time of processing the order, MaMuMa will immediately notify the customer of this in a separate email and refrain from issuing a declaration of acceptance. In this case, the contract will not be concluded. Any payments already made by the customer will be refunded immediately.

Important note:
According to § 312 b III No. 6 of the German Civil Code (BGB), ticket orders placed online are not subject to the rules governing distance selling contracts. Therefore, there is no right of withdrawal according to § 355 BGB. All orders are therefore final and binding.

3. Quantity restrictions

MaMuMa reserves the right to verify orders before execution.

4. Ticket refunds

The return of correctly delivered tickets is generally excluded. Any errors made by MaMuMa in the execution of orders will be corrected in accordance with the applicable legal provisions.

5. Postponement/cancellation of events

a. MaMuMa reserves the right to move events to other locations or dates for important reasons, especially in the event of illness of artists or bad weather for outdoor events. Purchased tickets remain valid; refunds are limited to cases where it is unreasonable for the customer to attend the new date.
Weather-related interruptions and shortenings are not intended, but are possible. The decision to cancel the event can only be made immediately on site. We ask the audience to wear appropriate clothing and to check the weather forecast in advance. Umbrellas are not permitted as they obstruct the view. In the event of cancellation due to extreme weather (definition: danger to life and limb in the event of thunderstorms directly above the venue, hail, storms above 8 Beaufort), the ticket price will be refunded unless 45 minutes of play have been reached.

b. If an event is canceled, the ticket prices will be refunded without shipping costs, postage, and system fees upon presentation of the original tickets.

6. Access for minors

Children under the age of 6 are not permitted to attend any events, even when accompanied by a parent or legal guardian, unless otherwise specified in individual cases. If children are not permitted to attend in accordance with sentence 1, they will not be admitted even if they are in possession of a ticket. In addition, the provisions of the Youth Protection Act apply. The house rules of the respective event venue and the instructions of the security personnel must be observed.

7. Liability/Limitation of Liability

a. MaMuMa shall be liable without limitation within the scope of the statutory provisions for damages resulting from even negligent injury to the life, limb, and health of the customer. The same applies to the breach of essential contractual obligations.

b. Liability for other damages in cases of simple negligence on the part of MaMuMa and its legal representatives and vicarious agents is excluded. Liability for gross negligence and intent remains unaffected.

8. Commercial resale

The commercial resale of tickets is not permitted unless MaMuMa has given its prior consent. Admission to a performance is only granted on presentation of a ticket purchased directly from MaMuMa, Ztix, Eventim, or a third party (in rare cases, the venue’s in-house ticketing system) with the prior consent of the respective ticket provider mentioned above. For each violation of the aforementioned prohibition, the perpetrator shall pay the organizer a contractual penalty of 2,500 euros. Furthermore, MaMuMa reserves the right to exclude persons who violate the above prohibition from purchasing tickets in the future.

9. Data storage/data protection

MaMuMa uses customers’ personal data only within the scope of what is legally permissible or with the customer’s consent under data protection law. For details on the handling of personal data, please refer to the privacy policy.

10. Applicable law/third-party terms and conditions

All contracts subject to these General Terms and Conditions shall be governed exclusively by the laws of the Federal Republic of Germany. Other general terms and conditions shall not apply.

11. Place of performance/place of jurisdiction

a. The place of performance for all mutual obligations is Mainz.

b. The Regional Court of Mainz shall have jurisdiction over all disputes with merchants, legal entities under public law, and special funds under public law concerning orders based on these General Terms and Conditions, including the execution of the event.
